Terms of Service

These terms are an agreement between you and Elitesgen, Inc.(“Elitesgen,” “we,” “us”), a subsidiary of the Elites Generation Foundation. They govern your use of the Elitesgenapp, our websites, and the Egen family of products that link to them (together, the “products”). Please read them carefully. By using the products, you agree to these terms.

Who can use the products

You must be at least 13 years old to use the Elitesgen app, and some features, including romantic connection, require you to be 18 or older. If you use the products on behalf of an organization, you confirm you have the authority to accept these terms for it.

Your account

You are responsible for the activity on your account and for keeping your login details secure. Please give us accurate information when you sign up and keep it current. Tell us promptly if you believe someone has used your account without permission.

Using the products well

The products exist to help people find real community and connection. Use them in good faith and in line with our community standards. In particular, you agree not to:

• Pretend to be someone you are not, or misrepresent who you are.
• Harass, threaten, deceive, or harm other people, or share content that is unlawful, hateful, or abusive.
• Misuse, disrupt, overload, or attempt to break or gain unauthorized access to the products.
• Collect other people’s information without their consent, or use the products to send spam.
• Use the products for anything illegal.

We may remove content or limit access that breaks these terms or our community standards.

Your content

You keep ownership of the content you create and share. To run the products, you give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your content for the limited purpose of operating and improving the products and showing your content to the people you intend it for. This license ends when you delete your content or close your account, except where it has already been shared with others or where we must keep it to meet a legal obligation.

Our content

The products themselves, including our software, design, and brand, are owned by Elitesgen, Inc. or the Elites Generation Foundation and are protected by intellectual property laws. These terms do not give you any right to use our names or marks without our permission.

The free core, and paid features

The essential parts of the products stay free. We may offer paid tiers or paid products in the Egen family; where we do, the price and any extra terms will be made clear before you sign up, and those terms apply in addition to these. Some Egen products publish their own supplemental terms for features specific to them.

Third-party services

The products may link to or rely on services we do not control, such as the app stores or external sites. We are not responsible for those services, and your use of them is governed by their own terms.

Disclaimers

We work hard to keep the products useful and reliable, but they are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. The products do not provide medical, psychological, legal, or other professional advice.

Limitation of liability

To the fullest extent permitted by law, Elitesgen, Inc. and the Elites Generation Foundation will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising from your use of the products. Where liability cannot be excluded, it is limited to the amount you paid us, if any, in the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Ending your use

You can stop using the products and close your account at any time. We may suspend or end your access if you break these terms or our community standards, if it is needed to protect people or the products, or if we are required to by law. Where it is reasonable to do so, we will give you notice.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where the law of your home country requires otherwise. If you have a concern, we ask that you contact us first so we can try to resolve it directly. This does not limit any rights you have under the consumer-protection laws of the place you live.

Changes to these terms

We may update these terms as the products change. When we make material changes, we will note them here and update the date above. If you keep using the products after a change takes effect, you accept the updated terms.
